Board of Trustee Minutes 1/23/2012

 

A regular meeting of the Board of Trustees of the Village of Delhi was held on January 23, 2012 at 6:30 p.m. in the Village Hall Boardroom. 

Present:               Mayor                   Richard Maxey

                            Trustees               Gregory Krzyston, Jeremy Fitch, Gerry Pilgrim               

Meeting began with the Pledge of Allegiance at 6:30 p.m. 

Privilege of the floor was granted to Don Trelease of the Hamden Hill Ridge Riders Snowmobile Club regarding proposed access by snowmobiles into the village.  The snowmobile club would need permission to cross village-owned property.  The Board decided they would like to see written permission from all other landowners before they make any decision. 

Motion was made by Trustee Fitch to approve the minutes of the regular meeting of December 19, 2011 and the special meeting of January 4, 2012.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Krzyston to approve the abstract dated January 23, 2012 in the amount of $160,774.36 plus an additional medical reimbursement voucher of $217.90.  Motion was seconded by Trustee Fitch and passed unanimously. 

Bill Brown from Delaware Engineering was present regarding Phase 3 of the Water System Improvement Project.  He has reviewed all 10 bids that were submitted and announced that Merritt Construction was the low bidder with a bid of $1,256,525. 

Motion was made by Trustee Krzyston to award the work of Water System Improvement – Phase 3, Contract No. VD1-G-11 to Merritt Construction, Inc., of Saugerties, NY, the low bidder, for the base bid price $1,256,525, and to also authorize the use of bid alternate pricing for work along Base Bid Streets, as listed in the bid tabulation, if required, as the basis of payment for additional work, contingent upon approval of the bid packages by USDA-RD.  Motion was seconded by Trustee Fitch and passed unanimously. 

Motion was made by Trustee Krzyston to authorize the Mayor to execute the necessary paperwork for contract initiation and completion of the work (e.g., Notice of Award, Notice to Proceed, Change Orders, Agreement, Certificate of Substantial Completion, checks for contractor payments, etc.).  Motion was seconded by Trustee Fitch and passed unanimously. 

Motion was made by Trustee Krzyston to authorize Delaware Engineering, P.C. to proceed with preparation of execution copies of the contract documents and forward said contracts to the contractor and Village for subsequent execution.  Motion was seconded by Trustee Fitch and passed unanimously. 

Motion was made by Trustee Pilgrim to approve the Police Report for December, 2011 and the Police Annual Report for 2011, the Code Enforcement Officer’s Report dated 12/14/11-1/18/12, the HUD Report for December, 2011 and the Treasurer’s Report for December, 2011.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Fitch to approve the Resolution for Joint Sale of Tax-Acquired Properties by the Village of Delhi and County of Delaware.  Motion was seconded by Trustee Krzyston and passed unanimously.  Resolution reads as follows: 

                WHEREAS, the County of Delaware has proceeded to foreclose on the following properties in the Village of Delhi; and

                WHEREAS, it is in the best interest of the Village and the County of Delaware to work together to protect the Village tax lien;

                NOW, THEREORE, BE IT RESOLVED, that the County of Delaware sell the interest of both municipalities, the proceeds from said sale shall be divided in proportion to the taxes owed each entity for the years 2010-2011.  Each parcel to be treated individually. 

Motion was made by Trustee Pilgrim to subscribe to the Walton Reporter for one year at a cost of $39.00.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Pilgrim to schedule a public hearing for proposed Local Law #1 of 2012 entitled “A local law to override the tax levy limit established in General Municipal Law §3-c” for February 27, 2012 at 7:00 p.m.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Fitch to approve resolution entitled “Standard Work Day and Reporting Resolution” as required by the New York State Retirement System.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Fitch to approve resolution entitled “Standard Work Day Resolution for Employees” as required by the New York State Retirement System.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Krzyston to designate the Village Hall as the official polling place for the March 20, 2012 Village Elections, with elections being held from 12:00 p.m. to 9:00 p.m.  Motion was seconded by Trustee Pilgrim and passed unanimously. 

Motion was made by Trustee Krzyston to appoint Ruth Vredenburgh and Mable Adams as elections inspectors for the March 20, 2012 election.  Motion was seconded by Trustee Pilgrim and passed unanimously. 

Motion was made by Trustee Fitch to authorize DPW Superintendent Curley to proceed with getting markers for 25 fire hydrants, with the cost coming from the water fund, at a cost not to exceed $750, and to direct the village board to approach the fire department about purchasing another 25 markers.   Motion was seconded by Trustee Pilgrim and passed unanimously. 

Motion was made by Trustee Krzyston to enter into executive session to discuss contract negotiations.  Motion was seconded by Trustee Fitch and passed unanimously. 

Motion was made by Trustee Fitch to exit executive session.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Open session resumed at 9:30 p.m. 

It was agreed that Wendell will make a presentation regarding an energy audit at the February 6, 2012 budget workshop at 7:00 p.m. 

Motion was made by Trustee Krzyston to adjourn.  Motion was seconded by Trustee Pilgrim and passed unanimously.
