Board of Trustee Minutes 11/19/2012

 

A regular meeting of the Board of Trustees of the Village of Delhi was held on Monday, November 19, 2012 at 6:30 p.m. in the Village Hall Boardroom. 

Present:           Mayor             Richard Maxey
                       Trustees          Gregory Krzyston, Jeremy Fitch, Gerry Pilgrim, Chris Maney                       

The meeting started with the Pledge of Allegiance at 6:30 p.m. 

Privilege of the floor was granted to Michael Knyphausen, Deb Corcoran, and James Robbins. 

Motion was made by Trustee Krzyston to approve the minutes of the regular meeting of October 15,  2012.  Motion was seconded by Trustee Fitch and passed unanimously. 

Motion was made by Trustee Krzyston to approve the abstract dated November 19, 2012.  Motion was seconded by Trustee Fitch and passed with Mayor Maxey and Trustees Krzyston, Fitch and Maney voting yes and Trustee Pilgrim voting no. 

Motion was made by Trustee Krzyston to accept the Police Report for October, 2012, the Code Enforcement Officer’s Report for 10/11 – 11/15/2012, the HUD Report for October, 2012, and the Treasurer’s Report for October, 2012.   Motion was seconded by Trustee Pilgrim and passed unanimously. 

Bill Brown was present to give an update on the Water System Improvement Project.  The main project has been completed.  He discussed the proposal from Alpha Geoscience for test wells. 

Motion was made by Trustee Krzyston to accept the proposal from Alpha Geoscience to drill test wells at two sites (Clark pit and Donahue sites) at a cost of $18,970.00.  Motion was seconded by Trustee Fitch.  Motion failed with Mayor Maxey and Trustee Krzyston voting yes and Trustees Maney, Fitch and Pilgrim voting no. 

***Mayor Maxey reminded that the offices to be filled at the election on March 19, 2013 are:  Mayor for a two year term and two Trustees for two year terms. 

Public hearing opened at 7:50 p.m. regarding the proposed local law entitled “Nuisance Parties Law”.

            Village resident Jim Robbins asked if there were going to be points assigned to this law to go along with the existing Nuisance Law.  He suggested assigning 10 points to the owner for a violation of this law.

            Deb Corcoran said that we need to change current laws to require a rental house to be owner-occupied.  She doesn’t feel safe in the village anymore.

            Cindi Cobb said that the Village needs to address the garbage problems.

            Trustee Pilgrim acknowledged that some changes may be need to be made, but said that the law should be passed so that the police department can start implementing it and see how it works out.

            Trustee Fitch would like to see fighting included in the law so to help the police department address those issues, and that all these types of laws should be tied together to save the village money. 

Motion was made by Trustee Pilgrim to close the public hearing at 8:16 p.m.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Pilgrim to adopt Chapter 200 law “Adding a Nuisance Parties Law to the Code of the Village of Delhi”.  Motion was seconded by Trustee Maney and passed with Mayor Maxey, and Trustees Maney, Pilgrim and Krzyston voting yes and Trustee Fitch voting no. 

Motion was made by Trustee Pilgrim authorizing the Mayor to sign a lease agreement with Xerox in the amount of $127.24 and a per-copy maintenance agreement with Xerox for a new copier in the Clerk’s office.  Motion was seconded by Trustee Maney and passed unanimously. 

Motion was made by Trustee Krzyston to schedule a public hearing on imposing a moratorium on certain activities relating to private wells in the Village of Delhi for Monday, December 17, 2012 at 7;15 p.m.  Motion was seconded by Trustee Fitch and passed with Mayor Maxey and Trustees Maney, Krzyston and Fitch voting yes and Trustee Pilgrim abstaining. 

The Board authorized the Mayor to send a “dangerous tree” letter to homeowners with trees dangerous to the public on their property, and to give the homeowners two weeks to remedy the situation before the village trims or removes the dangerous tree and bills the homeowner. 

There was discussion about the purchase of a new salt/sand spreader for the street department.  Motion to accept a proposal from Trux Outfitter for a new spreader was withdrawn after Trustee Maney asked that Mayor Maxey find out if we have spent any time or money on the spreader the DPW Superintendent has arranged to borrow from the Town of Delhi. 

Motion was made by Trustee Pilgrim to contribute to the Delhi Beautification Committee for holiday decorations, not to exceed $1,000.  Motion was seconded by Trustee Maney and passed with Mayor Maxey, and Trustees Maney, Fitch and Pilgrim voting yes and Trustee Krzyston abstaining. 

Motion was made by Trustee Maney to schedule a public hearing regarding the SUNY Subsurface Project for December 10, 2012 at 5:45 p.m.  Motion was seconded by Trustee Fitch and passed unanimously. 

Motion was made by Trustee Krzyston to approve payment of the 2012 Retirement System invoices in the amounts of $55,194.00 for Police and Fire Retirement and $119,256 for Employees Retirement.  Motion was seconded by Trustee Pilgrim and passed unanimously. 

There was discussion about the possible purchase of a new police vehicle.  Trustee Fitch is going to get together a “ready to roll” price on state bid vehicles. 

There was discussion about possibly re-allocating grant funds to replace bulbs in the village lamps with LED bulbs.  Mayor will look into this. 

There was a question about whether or not the village could open a skating rink, possibly at Smith Pond.  Mayor Maxey will make contacts. 

After receiving request to place “children at play” signs around the village, there was a question as to whether the village could change the speed limit to 25 mph on village streets.  The Mayor will consult with the village attorney. 

Motion was made by Trustee Fitch to pay for wagon rides at the winter festival out of the Joint Activities Fund in the amount of $400.  Motion was seconded by Trustee Krzyston and passed with Mayor Maxey and Trustees Fitch, Krzyston and Pilgrim voting yes and Trustee Maney abstaining. 

Motion was made by Trustee Maney to adjourn.
