Board of Trustee Minutes 9/19/2011

 

A regular meeting of the Board of Trustees of the Village of Delhi was held on Monday, September  19, 2011 at 6:30 p.m. in the Village Hall Boardroom.

Present: Mayor  Richard Maxey
        Trustees Gregory Krzyston, Christopher Maney, Jeremy Fitch, Gerry Pilgrim
    
The meeting started with the Pledge of Allegiance at 6:30 p.m.

Mayor Maxey wanted to be sure to thank Village employees Chris Hillis, Mike Brown, Jay Decker and Tom Little for their help in Margaretville after the recent flooding.

Privilege of the floor was granted to Ed Chytallo, Caryl Razler, Virginia Hoyt, Jim Robbins,  Matthew Healey,  Sue Gladding-Freer, Kathy Flanders, Cynthia Cobb, Gerry Pilgrim and Jeremy Fitch.

The Public hearing for the Nuisance Law revisions was opened at 7:35 p.m.

7:36 p.m. Darren Evans came in as a representative of the Delhi’s Annual Fair on the Square Committee regarding their request for a change to the guidelines allowing them to hang their banner for more than two weeks a year to promote their annual event.

After discussion, it was decided to send request for changes to the banner guidelines to the Community Committee (Gerry Pilgrim & Gregory Krzyston) for them to review and come back to the Village Board with recommendations.

Mayor Maxey then went back to the Nuisance Law revision and indicated that this law was written 3 years ago and this revision is to improve upon this law now that it has been in use.

Motion was made by Trustee Maney to approve minutes of the August 15, 2011 regular meeting.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Pilgrim to approve the Abstract dated September  19, 2011, totaling $116,290.71. Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Pilgrim to approve payment  to Delta Engineers in the amount of $2,707.71 for work done on the Transportation Enhancement Project.  Motion was seconded by Trustee Maney and passed unanimously.

There was some discussion as to whether the Village should continue with TEP or not?  Trustee Maney  and others agreed that there should be a meeting to discuss this item separate from our monthly meeting.

Mayor Maxey said that TEP could be put to bid and the Village could refuse all bids and decide not to continue with the TEP project but they would need to refund the grant money to the State.

Motion was made by Trustee Krzyston to approve payment to Delaware Engineering in the amount of $2,450.13 for Water System Improvement – Phase 3.  Motion was seconded by Trustee Maney and passed unanimously.

Motion was made by Trustee Krzyston to approve payment to Jeffrey Scanlan in the amount of $456.00 for lawn maintenance of a property in the village that will be billed to the property owner.  Motion was seconded by Trustee Maney and passed unanimously.

Members of the Village Board would like a more itemized description on the bill instead of just saying Phase 3 – what have they done?

Announcement was made that Halloween will be observed on Monday, October 31, 2011 during the hours of 4 p.m. and 9 p.m. in the Village of Delhi.
Motion was made by Trustee Krzyston to accept end-of-year report for the Delhi Village Basketball Program by David Martin dated August 17, 2011.  Motion was seconded by Trustee Pilgrim and passed unanimously.

Members of the board and the public were interested to know how many participants there were for basketball.  It would be good to include that information in the report.  Mayor Maxey will get in touch with David Martin to get that information for this year.
 
Motion was made by Trustee Krzyston to close the public hearing at 8:00 p.m.  Motion was seconded by Trustee Maney and passed unanimously.

Motion was made by Trustee Krzyston to accept the Police Report for August  2011, the Code Enforcement Officer’s Report dated August 12 – September  15, 2011 and HUD August 2011 report.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Krzyston to adopt the revised Nuisance Law amending page  3 of the DRAFT  §`199-3 Village’s Discretion Not to Assign Point – redrafted as below
“The Village Board may exercise its discretion not to assign points for violations in accordance with section 199-2 if the owner and/or any other person directly or indirectly in control of the premises where the violation occurred has been proactive in working with the Village on corrective measures to abate the nuisance.”  Motion was seconded by Trustee Pilgrim and passed unanimously.

The Chamber of Commerce has requested extra garbage cans to be placed around the Courthouse Square and to block the parking spaces on Court Street on the evening of Friday, September 23, 2011 so they will be available for food vendor parking on Saturday morning, September 24, 2011 for the Harvest Festival.  Discussion was had by Board members – no one had an issue with the request.  Mayor Maxey said the Village would honor their request.

Discussion was had about the letter dated 9/13/11 from a taxpayer asking for relief of her penalties.  The request was denied. 

Discussion was had regarding a letter from Robert Wilklow dated 9/14/11, also signed by his neighbors, requesting  that the curbing that was taken out of Second Street in the fall of 2010 be completed now with the curbing removed last year.  Trustee Maney indicated they would try to fit that into the schedule this year.

Motion was made by Trustee Pilgrim at 8:45 p.m. to enter executive session to discuss “personnel”.  Motion was seconded by Trustee Krzyston and passed unanimously.

Break until 8:58 p.m. and resumed to executive session.

Motion was made by Trustee Pilgrim to exit executive session.  Motion was seconded by Trustee Fitch and passed unanimously.

Open session resumed at 9:40 p.m.

Motion was made by Trustee Maney to approve the hiring of Matthew Davis as a Part-time police officer.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Maney to approve Chief Mills to expand his part-time list by 3 police officers.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Maney to approve the hiring of James Small as a part-time police officer.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Pilgrim to adjourn.  Motion was seconded by Trustee Fitch and passed unanimously.
